CHOOSING A LAWYER
ATTORNEY or NEGOTIATOR?
Are you choosing a law firm that can take your case to trial or are you selecting a negotiator? Almost every lawyer wants to be a trial lawyer or at least create the impression that they are one, it sounds pretty important to clients. Unfortunately, few lawyers have any trial experience.
Nelson & Natale continually receives referrals from clients as well as doctors. In the case of doctors, they realize that their patients have serious injuries. Client's current attorney is having serious problems moving the case forward. The attorney has little or any experience as a trial lawyer and the case is reaching the point of no return. In other words, unless the client changes to a trial lawyer immediately, his or her case will be worth nothing and the case will most likely be lost. Changing lawyers is the only alternative. How did the client get into this kind of predicament?
Here are a few questions to consider when deciding on which lawyer is best for your situation:
Does your prospective attorney really litigate personal injury cases, or does he/she just negotiate?
Does your prospective attorney handle only injury cases exclusively, or does he/she handle any case that comes in?
Does the attorney refer you out to an orthopedic surgeon? If not then he/she simply intends to split the medical bills
Does the attorney also specialize in Workers Compensation cases? (Workers Compensation is not Civil Litigation! It's a form of Insurance and Administrative Law)
Does the attorney tell you it will take less than a year for your case to settle? Filing a lawsuit and litigating will take at least a year and a half,
Does the attorney have a staff? How many actual law clerks does that firm have? If he/she has no staff, but only a secretary or two, they can't handle litigation cases.
